1. Membership Subscription

You must be at least 18 years old to enroll in a Caliber Car Wash Limitless membership. By enrolling, you authorize Caliber to charge your payment method on file on a recurring monthly basis on the anniversary date of your initial purchase, until you cancel. The membership renews automatically each month at the then-current rate, which will be disclosed to you at signup. Caliber will charge your payment method on file each month without further action by you. You may cancel at any time as described in Section 2, and cancellation will stop future charges. If Caliber changes the recurring charge amount, Caliber will provide at least 30 days’ advance notice by email before the new rate takes effect.

2. Changes and Cancellations

You may cancel, pause, or change your membership plan at any time online by visiting your home location page on calibercarwash.com and selecting Manage Your Limitless Account, by contacting your local Caliber Car Wash, or by emailing info@calibercarwash.com. Online cancellation is available 24/7 and does not require speaking with a representative. Cancellation requests must be submitted at least seven days before your next billing date to avoid the next charge. No refunds or credits are issued for partial months, except as required by applicable law.
Membership level changes are limited to one per ninety days. Caliber reserves the right to modify, suspend, or cancel any membership at any time, with or without notice, for any reason, including suspected fraud, misuse, sharing of a membership across multiple vehicles, abusive conduct toward employees, or violation of these Terms. Caliber may refuse service at any location.

3. Membership Terms and Conditions

Each Limitless membership is valid for one vehicle only, during normal business hours, at participating Caliber Car Wash locations. Caliber reserves the right to close or modify operating hours due to weather, equipment maintenance, special events, or other operational requirements. Rates and these Terms of Service are subject to change.

Disclaimer of warranties. The Caliber services are provided on an as-is and as-available basis. To the fullest extent permitted by law, Caliber disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Caliber does not warrant that the services will be uninterrupted or error-free.

Limitation of liability. To the fullest extent permitted by law, Caliber’s total liability for any claim arising out of or relating to your membership or these Terms is limited to the amount you paid Caliber in the twelve months before the event giving rise to the claim. Caliber is not liable for indirect, incidental, consequential, special, or punitive damages. Nothing in this section limits liability that cannot be limited under applicable law, including liability for gross negligence, fraud, or willful misconduct.

Vehicle damage claims. Claims for vehicle damage allegedly caused at a Caliber location must be reported to the on-site manager before you leave the property. Claims reported after you leave the property may be denied.

Changes to these Terms. Caliber will provide notice of material changes to these Terms by email to account holders or by posting on calibercarwash.com at least 30 days before the change takes effect.

Governing law. These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Nothing in this section deprives you of the protection of any non-waivable provision of the law of the state where you reside.

Dispute resolution. Any dispute arising out of or relating to your membership or these Terms will be resolved by binding arbitration administered by JAMS under its Consumer Arbitration Minimum Standards and applicable JAMS rules. The arbitration will take place in the county where you reside or, at your option, by phone or video. The arbitrator may award any relief a court could award, including injunctive and declaratory relief, but only on an individual basis.

Class action waiver. You and Caliber each waive any right to bring or participate in a class, collective, or representative action. Disputes must be brought in your individual capacity.

Small claims carve-out. Either party may bring an individual action in small claims court in lieu of arbitration if the claim qualifies.

Opt out of arbitration. You may opt out of the arbitration and class action waiver provisions by sending written notice to info@calibercarwash.com within 30 days of first accepting these Terms. Opting out will not affect any other provision of these Terms

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force.

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Caliber regarding the Limitless membership and the Caliber services.

Assignment. You may not assign these Terms without Caliber’s written consent. Caliber may assign these Terms in connection with a merger, acquisition, financing, reorganization, or sale of assets.

Force majeure. Caliber is not liable for any delay or failure to perform caused by events beyond its reasonable control, including natural disasters, severe weather, utility failures, supply chain disruptions, pandemics, labor disputes, or government action.

4. SMS Terms of Service

Marketing and Promotional Messages.
When you opt in to the Caliber Car Wash marketing SMS program — by texting our shortcode 225423, entering your mobile number on a Caliber web form with the SMS opt-in box checked, or signing up at one of our locations — we will send you a confirmation message. You will then receive recurring automated marketing and promotional text messages, including discounts on Limitless memberships, new location openings, seasonal promotions, member-exclusive offers, and account reminders.

Message frequency varies; expect up to ten messages per month. Message and data rates may apply. Reply HELP for help. Reply STOP to cancel. Consent to receive messages is not a condition of purchase. You must be at least 18 years old (or have parent/guardian consent) and be the account holder or authorized user of the mobile phone number provided.

Account Notifications.
When you provide your mobile number in connection with a Caliber account (such as a Limitless membership), we may send you account notifications from a 10-digit long code. These include receipts, password resets, payment failure alerts, plan changes, and similar service messages. Message and data rates may apply. Reply HELP for help. Reply STOP to opt out. If you opt out of account notifications, Caliber will not be able to send you receipts, password reset links, or billing alerts by text message, and Caliber will deliver these to you by email instead.

Customer Care Messages.
If you contact Caliber Car Wash by text message with a question or service issue, we will respond by text from a 10-digit long code. Customer care messages are sent only in response to a question or request you have initiated. Standard message and data rates may apply. Reply STOP to end the conversation.

Carrier and Delivery.
Wireless carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to effective transmission from your wireless service provider.

SMS Privacy.
We do not share consumer opt-in consent with any third parties. Mobile information and SMS data will not be shared with any third parties or affiliates for marketing, promotional, or any other purpose, other than (a) service providers operating our SMS platform on our behalf and (b) disclosures required by law. 5. Email Communications

By providing your email address, you may receive marketing emails, account notifications, and service messages from Caliber Car Wash. You can opt out of marketing emails at any time by clicking the unsubscribe link in any email; transactional emails will continue to be sent as needed to operate your account. Caliber complies with applicable commercial email laws.

6. Privacy Policy

Personal information collected through Caliber Car Wash services is handled in accordance with our Privacy Policy at calibercarwash.com/privacy-policy/. By using our services, you acknowledge that you have read and understood the Privacy Policy.
